REMINDER: Sunscreen Has Been Tax-Exempt Since June 18

Our office wants to remind all businesses collecting sales and use tax that sunscreen products are exempt from sales and use tax, as of June 18, 2012.
Rationale for June 18 Effective Date
In May, the Food and Drug Administration published a final rule to establish labeling and testing requirements for over-the-counter sunscreen drug products, and the rule requires sunscreen products to bear the drug facts panel. The FDA rule became effective June 18, 2012.
Because the FDA's final rule establishes different compliance dates for different manufacturers, the Comptroller's office uses the effective date of the rule, June 18, 2012, as the date sunscreen products became exempt from sales tax.
