Shelby County District Attorney Steve Mulroy, seen with Just City Executive Director Josh Spickler, announcing that prosecutors will not oppose cost waivers for low-income residents with outstanding court debt.    .

After consultation with Just City, a nonprofit organization that focuses on assisting Shelby County residents with receiving fair treatment within the criminal justice system, the DA's office will no longer oppose requests to waive court fines and fees for low-income defendants who cannot afford them. Although fees can range from any amount, most Memphians are still unable to afford them. Unless the fees are paid or waived, the debt  can prevent people from moving forward with actions such as expungements, obtaining driver licenses, getting jobs, and securing housing, triggering a cycle of debt and poverty.

The majority of the waivers issued will be granted to people who have been charged with non-violent and low-level offenses. The debts have historically been uncollectable, given poverty-stricken debtors' inability to pay.

Happening in Court

Evanny Littlejohn was tried and convicted of second degree murder in September. On Friday, Littlejohn was sentenced to the maximum penalty, 25 years, for killing her husband, Kantrell Littlejohn in September 2021. The victim's family were present both physically and virtually for the sentencing.

ADAs Regina Lucreziano and Sam Winning handled this case.

Bretran Thompson, a disbarred attorney accused of taking money from two victims to perform legal work in 2019, will be in court this week for a set disposition to determine if the defense would agree to accept a guilty plea agreement or to set a trial date. Thompson has been disbarred since January 1996. He has been charged with two counts of Impersonation of a Licensed Professional and two counts of Theft of Property $2,500-$10,000. The DA's office is seeking a conviction.

ADA Dennis Johnson is handling this case.

The trial involving Derwin Mobley concluded this week with the sentencing of 10 years for money laundering and conspiracy to manufacture, distribute, and sell controlled substances in 2019.

ADA Melanie Headley handled this case.

"Shelby County District Attorney General Steve Mulroy has taken nuisance actions against four properties since he took office in September 2022: the EZ Express, another convenience store in the Bethel Grove neighborhood and two residential properties in Whitehaven.

According to Mulroy, these properties breed criminal activity. Some people who talked to The Daily Memphian about the impact the establishments have on their neighborhoods are skeptical that the closures and security adjustments will have much of an impact. Others are more optimistic."

"In a press conference Tuesday, DA Steve Mulroy said that waiving these court fees and fines would make for a much safer Shelby County.

“My instruction to prosecutors is not to oppose the request for these kinds of waivers if they are people of limited means,” said Mulroy.

He says these financial burdens lead to a cycle of debt and continued poverty."

"Shelby County District Attorney Steve Mulroy says the average age of culprits keep shrinking.

"When it comes to these specific types of cases--auto thefts and auto break-ins--we have seen a significant rise in those under the age of 18,” Mulroy told Fox 13."

“I wish the judicial commissioners will lean into unaffordable bail more than they have been and cases where is a repeat criminal history," Mulroy said.
