Happening in Court

In Criminal Court Division 5, Chief Prosecutor Cavett Ostner and ADA Venecia Patterson won a guilty as charged verdict for Aggravated Arson. In this case, defendant Terrance Collins became angry with his child’s mother because she refused to give him money to buy methamphetamine. He then set her house on fire. The victims were able to escape, however there was significant property damage.

In General Session Division 15, ADA Carla Taylor handled the preliminary hearing of defendant Xavier Lee, accused of 3 counts of First Degree Murder, 2 counts of Criminal Attempt First Degree Murder, and 2 counts of Use of a Firearm in Commission of a Felony. The court found probable cause on all charges. In this case, the defendant, after being kicked out of his grandmother's apartment for bringing guns into her home, retrieved a firearm that was inside of the apartment. The defendant then shot and killed two men who were inside the apartment. He then went outside and fired shots at a vehicle, killing one woman and injuring a male sitting inside of the vehicle. The sole witness was the defendant’s grandmother, who was also a victim and witnessed the entire incident.

Also in General Sessions Division 15, ADA Jen Morris handled the preliminary hearing of defendant Antwon Freeman, accused of 1 count of Aggravated Assault and 1 count of 2nd Degree Murder. The court found probable cause on both charges. In this case, defendant Freeman attacked a man walking down the street outside High Cotton Brewery with a cinder block. Another man jumped into a witness's vehicle to pursue the defendant, following him into an abandoned building. Defendant Freeman was later found covered in blood and arrested, and the man who followed him was found stabbed to death inside the abandoned building.

On Tuesday, DA Mulroy, with Director of Community Affairs ADA Tracye Jones and ADA Forrest Edwards, spoke at the Retail Theft Deflection (RTD) Initiative meeting, held at the Walgreens corporate office. There, retailers shared concerns about theft, monetary loss, and safety. Pictured above, ADA Forrest Edwards (second row, left) and DA Mulroy (center). DA Mulroy and the ADAs spoke about the SCDAG Office's smash-and-grab business burglary task force, and our partnership with the MPD Major Gang Unit. DA Mulroy also discussed a misdemeanor shoplifting diversion program soon to be launched.

DA Mulroy had a great time Saturday at the 20th annual Frayser Spring Festival at the Ed Rice Community Center. Pictured above, DA Mulroy and Community Prosecutor, Austin-Peay Precinct, ADA Lora Fowler. ADA Fowler shared information about SCDAG Office programs, and gave out school supplies and gift cards. The event was hosted by the Frayser Community Association, of which she serves on the board.

DA Mulroy Visits MPD Precincts for Roll Call

DA Mulroy has started to visit all police precincts for roll call. So far, he has visited Airways Station, N. Main, and Mt. Moriah precincts. He introduced himself to the troops, expressed his appreciation for their work, pledged to work with them, and took their questions. Questions ranged from general ones of policies and priorities to specific cases. For the latter, he looked up the details and got back to them within a few days.

Last week, Assistant Deputy District Attorney Ernest Brooks and Special Assistant District Attorney Jessica Indingaro attended the Safety and Justice Challenge Network Conference in St. Louis. The SJC is a network of "fifty-seven participating cities, counties, and states across the country doing the on-the-ground work of reimagining and rebuilding local justice systems."

Last week Thursday, ADA Errol Harmon represented SCDAG at the Memphis Business Academy Career Fair.

From The New York Times: No Criminal Charges for Former Officer Who Fired Taser at Tyre Nichols

Steve Mulroy, the Shelby County district attorney, repeatedly stressed in a news conference Tuesday that the decision not to charge Mr. Hemphill did not fully absolve him. But he noted that Mr. Hemphill was not among the officers who initially stopped Mr. Nichols on his drive home. And while Mr. Hemphill fired a Taser at Mr. Nichols as he fled, he was not among the officers who chased Mr. Nichols and brutally beat and kicked him near his home.

Lawyers for Sample presented the case to Shelby County judge Paula Skahan in February 2023 and asked her to vacate the death sentence. Current Shelby County DA Steve Mulroy didn’t challenge the request.

“The defendant met all three prongs of the test for intellectual disability,” Mulroy said. “I am convinced Michael Sample is intellectually disabled or was at the time of the offense.”
