Hand Count of Ballots

The Election Division hereby provides notice of a permanent administrative order for OAR 165-007-0290. Prior to the effective date of the administrative rules, the Elections Division held a public hearing and allowed time for public comments to be submitted. 

This change is being made to ensure hand count data is based on a full account of all legal votes cast in the election. It is required to comply with HB 3291 (2021), a legislative mandate the Elections Division is required to follow and implement. This amendment does not change the process by which hand counts are conducted and does not impact ballot counting procedures. 

RULE TITLE: Hand Count of Ballots

FILING CAPTION: Changes the date and time of the data used in hand count calculations

RULE SUMMARY: This amendment provides that the results posted to the Secretary of State's electronic reporting system for unofficial results as of 5 p.m. the fourteenth day after the date of the election will be used calculate the margin of victory and to determine the percentage of precincts or ballot count batches to be hand counted.
