Designating the Vote By Mail Procedures Manual

The Elections Division hereby provides notice of a temporary administrative order for OAR 165-007-0030. More information may be found below and on our website.

This temporary rule went into effect today, September 21, 2022 and will end on March 17, 2023.  

FILING CAPTION: Amends Vote by Mail Manual, related procedures, forms, and requirements for conducting elections.

NEED FOR TEMPORARY RULE: These amendments are needed to provide updated and clear guidelines for county elections officials to follow when conducting an election. The rule is adopted as a temporary rule due to the timing of an upcoming election.

JUSTIFICATION FOR TEMPORARY RULE: The rule is adopted as a temporary rule due to the timing of an upcoming election. The manual provides detailed information for phases of elections administration and the time to conduct regular rulemaking procedures in between Primary and General Elections was not conducive to a full rulemaking procedure.

Without this temporary rule, county elections officials would not have clear enough guidance to uniformly conduct elections. All voters, candidates, and county elections officials would suffer consequences if clarity is not provided in advance of the upcoming election. Temporary rulemaking and adoption of the Vote By Mail Manual would mitigate these consequences because the manual provides elections officials with specific instructions and procedures about how to conduct elections in Oregon.
