Proposes Rule For Reporting Tally of Ballots Received On and After Election Day

The Election Division is providing this notice of proposed rulemaking activity for OAR 165-007-0550, a new administrative rule which creates processes and guidance for reporting the status of the tally of ballots received on or after election day. The Division has filed notice regarding the new rule, has scheduled a public hearing, and will accept public comments. More information may be found below and on our website.

RULE SUMMARY: The proposed rule outlines the procedure for reporting the status of the tally of ballots received on and after election day. The rule sets forth the method and timeline by which county elections officials must report information to the Secretary of State and the public.

HEARING: The public hearing for this rule will be conducted virtually via Microsoft Teams.  The hearing will take place on January 24, 2022 from 2:00 p.m. to 3:00 p.m. Visit our website for more information.

PUBLIC COMMENTS: Public comments may be sent to the Elections Division until January 25, 2022 at 3:00 p.m.

NEED FOR RULE: In enacting HB 3291 (2021) the Legislative Assembly directed the Secretary of State to adopt rules to establish a procedure for announcing the status of the tally of ballots received after the date of the election. This rule is needed to outline the method and timeline by which county elections officials must report the tally of ballots received on and after election day.
