Whether or not you treat workers’ compensation patients, the Workers’ Compensation Division (WCD) wants Oregon health care providers to know that we’re here to help with improving the delivery and affordability of medical service in workers’ compensation. WCD’s Medical Section provides dispute resolution, free training at your office, billing and fee schedule help, certification and authorization, and more. The division is committed to helping the workers’ compensation process run smoothly by educating the medical community regarding the requirements and limitations surrounding medical care and supplying accurate and necessary information about workers’ compensation claims. Form 827: "Worker’s and Physician’s Report for Workers’ Compensation Claim."

When treating workers’ compensation patients you only need to complete Form 827 for these circumstances:
  • You are the very first health care provider the worker sees for his or her work related injury or disease (First report of injury or disease)
  • To request that the insurer accept a new or omitted medical condition
  • To report an aggravation of the original injury
  • The worker changes his or her  attending physician to you
Be sure to give the worker a copy of Form 827 and Form 3283 included with the Form 827. You must send the form to the insurer within three days (72 hours) when it’s the first report of injury or disease. For all other circumstances listed above, you have five days to mail the form.

Do NOT ask the worker to complete Form 827 when you use the form for the following reports:
  • Progress report
  • Closing report
  • Palliative care request
For these reports, you have the option of using Form 827, but do not ask the worker to complete the worker section.

Did you know?
Emergency room physicians may not be attending physicians if they refer the patient to another provider for medical services.  This means that when the worker comes to your office after a visit to the ER, you do not need to have the worker/patient fill out the worker portion of form 827, as this does not qualify as an attending physician change.  You still might want to use the 827, but please don’t have the worker/patient sign the form.
