As of July 11, 2025, a notice of intent to drill must be filed before drilling test holes that will be cased. Test holes drilled before July 11, 2025, are exempt from this requirement. All domestic and stock wells remain exempt from the notice of intent to drill requirement.
Why Was the Rule Changed? The updated rule closes a loophole that allowed wells to be completed without a proper permit by labeling them as “test holes.” If a test hole is clearly intended to become a permanent well, you and your customer now must follow the proper permitting and authorization steps.
Why the Notice of Intent Process Matters The OWRB requires you to file a notice before drilling to help ensure:
- the well is authorized to be drilled under a valid permit
- the well location, spacing, and construction meet legal requirements
- you and your customer are protected from protests, legal issues, and expensive mistakes
