New Emergency Rules Effective July 12, 2025

New emergency rules go into effect July 12, 2025. These rules are necessary to implement bills that became law during the 2025 legislative session and to restore the June 2, 2025, emergency rules that were superseded (when permanent rules went into effect July 11, 2025). The rules implement legislative changes by HB 2807, SB 518, SB 774, SB 1039, SB 1066 and will be incorporated into OMMA’s permanent rules during the next round of permanent rulemaking later this fall.

View a summary of the changes below:

  • Updates to commercial transporter warehouse requirements for HB 2807 (2025) were added to OAC 442:10-3-1 and OAC 442:10-3-6.
  • Changes to the national fingerprint-based background check requirement for HB 2807 (2025) were added to OAC 442:10-5-1.1.
  • Rules requiring medical marijuana to be sold in pre-packaged quantities for HB 2807 (2025) were added to OAC 442:10-7-1 and OAC 442:10-7-2.
  • An additional warning label for medical marijuana packaging required by SB 518 (2025) was added to OAC 442:10-7-1(d)(2).
  • Changes to the patient license number and a new PDF417 barcode required by SB 774 (2025) were updated at OAC 442:10-2-6(7).
  • Rules requiring patient applications to be resubmitted within 30 days of rejection required by SB 1039 (2025) were added to OAC 442:10-2-1(b), OAC 442:10-2-1(g), OAC 442:10-2-2(b), OAC 442:10-2-2(h) and OAC 442:10-2-4(e).
  • Changes requiring commercial applicants to pay all required license and application fees within 45 days of notification from OMMA per SB 1039 (2025) were added to OAC 442:10-4-1(b), OAC 442:10-5-1(b), OAC 442:10-5-2(a), OAC 442:10-5-3(a) and OAC 442:10-9-1(c).
  • Updates to the registry of recommending physicians and new and continuing medical education requirements for SB 1066 (2025) were added to OAC 442:10-1-9 and OAC 442:10-1-9.1.
