Effective Nov. 1, Senate Bill 1939 will amend the commercial license transfer process. Here are some highlights from the changes:
- Individuals who wish to purchase an existing business license must first apply for a new OMMA license and upon approval from OMMA, apply for an OBNDD registration. Upon approval of their OBNDD registration, the licensee has 15 business days to complete the transfer of the business license.
- Ownership change request fees will be different. The stand-alone ownership change request fee will change from $500 to the underlying annual business license fee, which is $2,500 plus any applicable tiered fees. This application fee change ensures the buyers receive a full year of licensure upon OBNDD approval, which completes the full license transfer.
A recent Metrc bulletin provides an update on the workflow to create clone batches.
Updates to OMMA rules now require a package tag to be associated with clone batches before they reach 12 inches in height (OAC 442:10-5-6(f)(3)(D) in OMMA’s rules). This required a configuration change to the state’s seed-to-sale tracking system.

The U.S. Drug Enforcement Administration (DEA) will hold a public hearing Dec. 2 about easing federal restrictions on marijuana through rescheduling.
The U.S. Department of Health and Human Services (HHS) recommended rescheduling marijuana last year, and the DEA hearing continues the extensive federal rulemaking process. HHS officials recommended moving marijuana from a Schedule I substance to a Schedule III substance on the Controlled Substances Act (CSA). The CSA is made of five schedules based on a drug’s acceptable medical use and a drug’s abuse or dependency potential.
Marijuana is classified currently at Schedule I, which is defined as a substance with no currently accepted medical use and a high potential for abuse. Moving marijuana to the lower-tier Schedule III wouldn’t legalize marijuana federally, but it could loosen restrictions on research and legal commerce that come with the Schedule I status.

To verify or update contact information, log in to the licensing portal and select your business profile. Locate your business license, select Manage Business and choose Update Contact Information. These steps will allow you to check for accuracy or make necessary changes.
OMMA Emergency Rules As a reminder, Gov. Kevin Stitt signed OMMA emergency rules effective Aug. 16. The emergency rules provide a structure for implementing legislative requirements from the 2024 legislative session. Permanent rules that fully implement the provisions set forth in the new legislation cannot be promulgated until 2025. Learn more in this email from OMMA sent Aug. 21.

Q: Can a commercial grower use old GAAA tags after their license number changes to GAAI or GAAO for an indoor and/or outdoor grow?
A: Licensees may continue using the remaining tags with the old license number until they run out. When licensees order new tags under the new license number(s), the new tags will reflect the updated number(s).
Q: Can someone make a purchase from a dispensary using their approval email or expired patient license?
A: Patients must have their physical unexpired patient license to purchase medical marijuana from a dispensary.
