Gov. Kevin Stitt recently signed three new state laws that adjust the requirements for commercial medical marijuana license applications, employee credential processing and final product testing.

Certificates of occupancy (COOs): Once a COO showing full compliance has already been submitted in an initial commercial license application or previous renewal, renewal applicants must only submit an affidavit stating the premises continues to comply with applicable zoning, municipal ordinances and safety codes. Municipalities and the State Fire Marshal may implement inspection programs to verify compliance. Details are in SB 1635 (2024).

Final product testing: Growers and processors shall not transfer any product to a dispensary until it has undergone and passed final product testing. The full, new final product testing requirements are included in SB 1635 (2024).

Fingerprint background checks: Clarified requirements for a national, fingerprint background check conducted by the Oklahoma State Bureau of Investigation (OSBI) are outlined in HB 1734 (2024) but will take time to come into effect. For now, continue to submit commercial license applications with the required Attestation Regarding National Background Check and a completed state background check from OSBI. OMMA will update licensees when the process changes.

Employee credential applications: SB 758 (2024) authorizes OMMA to reject, instead of deny, applications for employee credentials. This will allow applicants with missing information or errors to re-submit a corrected application without paying a new application fee or providing new copies of already-approved documents.
