Expired Guidance for Staff Vaccination Requirements

Expired COVID-19 Staff Vaccination Requirements

On July 25, 2023, CMS issued QSO-23-02-ALL and notified Medicare and Medicaid facilities the final rule has been published which ended the requirements related to COVID-19 Staff Vaccination for all provider types. The regulations in this final rule are effective on August 5, 2023.

The Oklahoma State Department of Health Long-Term Care Department notified providers during the LTC Provider Call on June 21, 2023 of CMS’ final rule for ending the vaccine mandate. Once a rule is published there is a 60-day waiting period before it takes effect. The regulations in the final rule are effective August 5, 2023. While the final rule is not yet effective, CMS decided to forgo the waiting period and stated, as of June 5, 2023, staff vaccination requirements will not be enforced and surveyors were no longer required to assess compliance with these requirements.
