OMMA Town Halls and Legislative Session

Last month, the Oklahoma Medical Marijuana Authority (OMMA) hosted a series of town halls for patient and commercial licensees to share feedback with OMMA ahead of Oklahoma’s legislative session.

One of the most common themes from licensees was a desire to see changes that would require new state laws. While OMMA is hard at work on improving our internal processes, we must follow the letter of the law.

Oklahoma’s annual legislative session began Feb. 6. Until the end of May, lawmakers will consider thousands of bills, some of which are relevant to Oklahoma’s medical marijuana industry. Now is the time to reach out to your legislator and share your story and experience regarding bills that are important to you. It’s still very early in the legislative process.

Engagement Opportunities

Veterans Roundtable
OMMA is pleased to announce our next Veterans Roundtable from 1-3 p.m. March 16. This session will focus primarily on product testing.

The session is in the Multipurpose Room on the first floor of the east side of the Oklahoma State Capitol in Oklahoma City, 2300 N Lincoln Blvd.

Please RSVP to attend. Free parking is available in the south lot. The closest entrance is on the east side, and ADA compliant entrances are on the south and west sides. Administrators of the Oklahoma State Capitol recommend parking in the south lot. Parking is free, but the area can get crowded when the Legislature is in session (February-May). Tobacco and cannabis consumption are prohibited in and around the state Capitol.

Patient Rights and Responsibilities

OMMA-licensed patients have rights and responsibilities associated with their medical marijuana license. Visit omma.ok.gov/rights to find answers to common questions pertaining to patients’ rights, as well as helpful information and resources.

Embargoed and Recalled Products

As a reminder, OMMA can order embargoes. OMMA-licensed businesses can issue voluntary recalls, and OMMA can also ask businesses to issue them. Be sure to bookmark and refer to our Embargoed and Recalled Products webpage at omma.ok.gov/recall. State laws and OMMA rules require the businesses to provide notice to patients who bought recalled products.

OMMA Dashboard

The OMMA Dashboard provides licensees and the public with data and analytics for Oklahoma's medical marijuana industry — including the number of commercial licenses by county, reported sales and harvest/plant counts, just to name a few.

Powered by NCS Analytics, this tool actively monitors and analyzes data from multiple systems like the state’s seed-to-sale tracking system. OMMA uses this information to help guide compliance and enforcement activities. View this data-driven tool by visiting omma.ok.gov/data.

Tax Report

Patients pay the 7% State Question 788 excise tax when buying medical marijuana products at a dispensary. As of fiscal year 2023, the revenue is handled as proposed in SQ 788:

It goes first to OMMA’s authorized budget.
Then, 75% of excess revenue is earmarked for education via the general fund, and 25% is earmarked for drug and alcohol rehabilitation via the state Health Department.

OMMA does NOT receive state or local sales tax revenue. Patients pay state and local sales tax when buying medical marijuana products at the dispensary. The rate varies by city/county and is the same at dispensaries as other non-medical marijuana retailers in the same area. The money goes straight to the state government and city/county — OMMA never touches it. State and local sales tax revenue funds things like education, general state government and municipal/county services (streets, public safety, etc.).

Submit a Business Complaint

Complaints about medical marijuana businesses are reviewed by OMMA’s Compliance Department. Compliance inspectors and/or law enforcement officers may follow up on complaints for further investigation.

Visit omma.ok.gov/complaint to use the OMMA Business Complaint form. You may remain anonymous if you want. Please provide as much information as possible. Complaints are reviewed in the order received, but threats to public health and safety are prioritized.

License Surrender

Licensees who wish to voluntarily surrender their OMMA license may do so by visiting omma.ok.gov/surrender.

Upcoming Holiday

OMMA and other state agencies will be closed Monday, Feb. 20, for Presidents Day. Even when OMMA is closed, individuals can l og in to the licensing portal to apply for or manage any license with OMMA.
