House Bill 2612 in 2019 directed OMMA to make Oklahoma the first state in the nation to implement a seed-to-sale tracking system for an already-established and growing medical marijuana industry. After OMMA partially settled a court case on Feb. 25, 2022, OMMA had 90 days to implement this new endeavor.
From Feb. 25 to May 26, 2022, seed-to-sale implementation was the top priority for OMMA and its staff. OMMA created a dedicated seed-to-sale page on its website and initiated a public awareness campaign consisting of over 1,000 phone calls to businesses, 24 social media posts, around 30 mass emails, 10 in-person and virtual training seminars, four explanatory videos, two news releases, one media briefing, a process flow chart and a 30-page searchable FAQ PDF. It was all rolled out alongside staff training and meticulous internal planning.
The sheer magnitude of this endeavor was unprecedented, but by May 27, 2022, 80% of OMMA’s commercial licensees were credentialed in the seed-to-sale system. As for the other 20%, OMMA has worked diligently since seed-to-sale went online to hold them accountable — since May 27, 2022, OMMA has:
- Issued 2,428 notices of monetary penalty,
- Filed 252 actions enforcing monetary penalties, and
- Argued 190 cases.
There are currently 567 revocation actions pending. The revocation process is the second step to the enforcement of the seed-to-sale requirement (with fines being the first). As OMMA moves forward as an independent agency, technology like seed-to-sale — alongside increased compliance staff conducting more inspections — helps us regulate one of Oklahoma's largest industries.
