The LTC Provider call held Wednesday, May 12, 2021, included key information related to: CLIA, Grids (Visitation, Testing), Nurse Aide Registry – CNA Waiver, COVID-19 State of Emergency Withdraw and Recension - Executive Order 2021-11, QSO-21-19-NH, and Provider calls – moved to a monthly bases.

Long-Term Care (LTC) Facility Vaccine Immunization Requirements for Residents and Staff
On May 11, 2021, CMS published an interim final rule and updated state agencies in QSO-21-19-NH. This rule establishes Long-Term Care (LTC) Facility Vaccine Immunization Requirements for Residents and Staff.
The interim final rule includes new requirements for educating residents or resident representatives and staff regarding the benefits and potential side effects associated with the COVID-19 vaccine, along with offering the vaccine. Additionally, LTC facilities must now report COVID-19 vaccine and therapeutics treatment information to the Centers for Disease Control and Prevention’s (CDC) National Healthcare Safety Network (NHSN).
CMS will post the new information reported to the NHSN on CMS’s COVID-19 Nursing Home Data website.
The rule applies to Medicare and Medicaid Programs and Intermediate Care Facilities for Individuals with Intellectual Disabilities (ICFs-IID) and includes residents, clients, and staff.
Noncompliance related to the new requirements for educating and offering COVID-19 vaccination to residents and staff will be cited at F-tag 887, and noncompliance related to COVID-19 vaccination reporting will be cited at F-tag 884. Civil monetary penalties (CMP) may also be imposed.

CDC Guidance for HealthCare Settings
Facilities are encouraged to follow CDC guidance as it pertains to healthcare facilities. The Interim Public Health Recommendations for Fully Vaccinated People do not apply to healthcare settings. This means that staff, residents and visitors should continue to wear masks as recommended in all healthcare facilities.
Long-term care providers should continue to refer to the Updated Healthcare Infection Prevention and Control Recommendations in Response to COVID-19 Vaccination for recommendations regarding source control and physical distancing in healthcare settings. CDC is considering how, or if, the updates for the community should be applied in healthcare and will update the healthcare guidance accordingly.
