The Latest on Legislation

HB 4454: New Packaging Requirements

House Bill 4454 creates clarity around requirements for OMMA-licensed processors when packaging and labeling medical marijuana products. The new law gives specific instructions to the industry regarding product shapes, styles and packaging characteristics that are considered appealing to children including cartoons, toys, animals or likeness to commercially available candy.

• Processors are responsible for ensuring compliance with HB 4454 for all products they package and label.
• Dispensaries are also responsible for ensuring any inventory they accept complies with HB 4454. Anything packaged and labeled on or after Nov. 1, 2026, must meet the new requirements put into law by the legislature.

As the state’s medical marijuana regulatory agency, the Oklahoma Medical Marijuana Authority will enforce the new law beginning on Nov.1, 2026

OMMA Permanent Rules in Effect

OMMA's current rules went into effect July 11, 2026.

The permanent rules implement legislative changes from the 2025 legislative session, including HB 2807, SB 518, SB 774, SB 1039 and SB 1066. Additionally, permanent rules include amendments made to July 12, 2025 emergency rules.

Monitoring Federal Marijuana Rescheduling Status

OMMA is closely monitoring the new federal final rules rescheduling state-licensed medical marijuana to Schedule III, as well as the ongoing Department of Justice (DOJ) and Drug Enforcement Administration's (DEA) hearings addressing broader cannabis rescheduling.

Marijuana is currently federally classified as Schedule I, which is defined as a substance with no currently accepted medical use and a high potential for abuse. Moving marijuana to the lower-tier Schedule III wouldn’t legalize marijuana federally, but it could loosen restrictions on research and legal commerce that come with the Schedule I status.

The final transcript and decision from the DEA Administrator will follow after the proceedings.

Advisory Council Meeting

A recording of the July 17th Advisory Council meeting can be found here on the State Senate's webpage. OMMA will continue to communicate new information with licensees as we work toward implementing HB 4454.

The next OMMA Advisory Council meeting is scheduled for October 16, 2026 at 9 a.m.

OMMA Launches New Webpage Highlighting Quality Assurance Lab

In June, OMMA launched a new webpage dedicated to the OMMA Quality Assurance Laboratory (QA Lab).

Authorized by Senate Bill 813 in 2023, the QA Lab integrates advanced testing capabilities directly into Oklahoma’s medical marijuana regulatory framework. The QA Lab is a key initiative designed to strengthen regulatory oversight, increase transparency and support patient safety across the state’s medical marijuana market.

OMMA Launches New Webpage on Recall Process

OMMA recently published a webpage outlining licensee roles and responsibilities in the medical marijuana recall process.

The new page features embargo and recall definitions, triggers and actions steps required by state statutes and administrative rules.

Updated Forms on
OMMA's Website

To assist with timely renewal and application processing, licensees are responsible for ensuring that all forms submitted with their application are the current, most recent versions provided by OMMA.

To align with current requirements, OMMA has updated the Affidavit of Lawful Presence form. Applications submitted with a previous version of this form will be rejected, and applicants will be required to resubmit using the updated form.

Accepting Alternative ID Methods

Dispensaries may accept an official OMMA approval email or proof of approved status in the OMMA MedPortal in lieu of a physical patient license card when accompanied by a valid government-issued photo ID.

Dispensaries must also verify that the patient's license is active using OMMA Verify.

Submit a Business Complaint

OMMA encourages anyone with information regarding potential illegal or non-compliant marijuana operations to submit a tip via the Business Complaint Form.

Tips may be submitted anonymously. All submissions are reviewed by OMMA's Office of Investigation and Enforcement (OIE).

Scam Alert: Fraudulent Architectural Seals

OMMA is aware of a scam involving fraudulent architectural seals on business plans. Businesses are encouraged to exercise caution when obtaining seals, certifications or permits, and to always verify the authenticity of official documentation. To report suspicious activity or file a complaint, please contact the Oklahoma Board of Architects, Landscape Architects and Licensed Interior Designers.

Potential red flags to look for on architectural seals:

• An architectural seal from another state
• An engineering seal on architectural pages
• Any license numbers that do not follow the “a” followed by four or five numbers
• Seals without a signature or date
• Pixelated seals
• Digitally signed seals with a different name in the metadata than is on the signature

Tips for verifying legitimate architectural seals:

• Required to have the words “Licensed Architect, State of Oklahoma”
• Required to have the licensee’s name and license number
• Oklahoma architectural license numbers start with the letter “a” and are followed by four or five numbers
• The four-number license numbers are pre-Thentia and begin immediately with a number after the “a” (i.e. a6345)
• The five-number license numbers all begin with a 0 after the “a” (i.e. a09826)
• Licensees are required to sign and date any documents they place their seal on

Water Usage and Waste Management

Sewage

Beyond the source of a facility's water, waste from restrooms, sinks, and showers requires specific regulatory oversight. If a property is not connected to a municipal sewer system, an approved on-site sewage treatment system is required.

All on-site systems must be properly permitted and inspected by the Department of Environmental Quality (DEQ). Systems intended for domestic sewage should not be used to dispose of cultivation wastewater or other industrial or process waste unless specifically authorized. Facilities should contact DEQ to determine the proper method for managing wastewater generated by their operations.

Wastewater

The disposal of industrial wastewater — which encompasses any combination of wastewater from facility cleaning, nutrient excess, waste or runoff, and reverse osmosis reject water — often requires a dedicated permit from the DEQ.

Growing mediums

A facility's cultivation setup directly affects water demand and usage, as each substrate has vastly different absorption and retention rates.

Growing mediums can be chosen strategically by assessing water consumption demands alongside the facility's verified local water resources and utility capacity. The facility's water delivery system can then be calibrated based on the selected medium's unique absorption and retention rates.
