Attorney General Platkin Joins Lawsuit Challenging Trump Administration Attack on Clean Vehicles Program
On June 12th, New Jersey Attorney General Matthew J. Platkin joined a coalition of 11 attorneys general in suing the federal government to challenge the unprecedented and unlawful use of the Congressional Review Act (CRA) to disapprove state Advanced Clean Cars II (ACCII), Omnibus, and Advanced Clean Trucks (ACT) standards, which California had issued under the Clean Air Act and New Jersey subsequently adopted. Waivers under the Clean Air Act, which allow for California and other States to adopt vehicle emission regulations that are more stringent than federal standards, have never been subject to the CRA, and its invocation contradicts nonpartisan determinations that the CRA does not apply to these waivers.
Under the state rules at issue, which New Jersey adopted in 2023 and 2021, 80% of the passenger vehicles sold in the state must be zero-emission by model year 2035, while the remaining 20% may be plug-in hybrids. The Advanced Clean Truck and Omnibus regulations are particularly critical for mitigating air pollution and public health stressors in overburdened communities with higher rates of truck traffic, aiming to accelerate adoption of zero emission vehicles in the medium and heavy-duty truck sector and impose stricter standards for nitrogen oxides emitted by internal combustion heavy-duty trucks to help prevent smog. The complaint filed challenges the federal government’s decision to break basic procedural norms in order to shut down state clean energy policies, asking the court to declare the resolutions to be unlawful and to require the Administration to implement the Clean Air Act consistent with the granted waivers. NJDEP Issues First Environmental Justice Law Decision
On June 5th, NJDEP issued its first EJ Law Decision under NJ's Environmental Justice Regulations, which details conditions for permit approvals regarding the proposed expansion of Linden Recycle Center in Union County. In addition to onsite pollution control measures outlined in the applicant's Environmental Justice Impact Statement, NJDEP is requiring the facility to develop of an anti-idling program, conduct a fleet evaluation, and implement a community engagement plan. Paterson Environmental Justice Community Engagement Session
Join NJDEP’s Office of Environmental Justice, in partnership with Paterson Alliance, for the Paterson Environmental Justice Community Engagement Session! DEP Commissioner Shawn LaTourette and DEP Office of Environmental Justice Director Kandyce Perry will meet with residents in Paterson's overburdened communities to discuss environmental justice concerns, share resources, and answer questions. Member organizations of Paterson Alliance's newly established Environmental Justice Working Group will highlight efforts to address environmental justice issues locally, and how residents can get involved.

Public Comment Period Now Open for NJDEP Noise Control Rule Proposal
NJDEP and the New Jersey Noise Control Council are proposing amendments to the state's Noise Control Rules. The proposed amendments and repeals will update the Noise Control rules to consolidate definitions, amend definitions that are not sufficiently descriptive, and update measurement procedures and sound level measurement device requirements to reflect modern technology in broad use.
A public hearing concerning the proposal will be held virtually on July 7, 2025, at 6 P.M. If you are interested in providing oral comments at the virtual public hearing, please email the Department at michelle.feasel@dep.nj.gov no later than 3:00 P.M., on July 7, 2025, with your contact information.

Funding and Technical Assistance Opportunities

NJ Fleet Advisor Fleet Electrification Assistance Program
Applications are now open for the second round of the New Jersey Fleet Advisor (NJFA) program! New Jersey Fleet Advisor will provide technical assistance to 15 fleets interested in learning how to transition to zero-emission vehicles. Participating fleets will receive a personalized Fleet Electrification Roadmap document that reviews vehicle recommendations, cost projections, on-site electric infrastructure assessments, and other key information to support the transition to zero-emission alternatives. The program will help to reduce administrative burdens for fleet decisionmakers, expand access to resources and technical information, and help facilitate clean energy transition throughout the state. Public, private, and non-profit entities, including school districts, are eligible to apply.

Historically, New Jersey’s low-income communities and communities of color face a disproportionately high number of environmental and public health stressors and, as a result, suffer from increased adverse health effects. New Jersey seeks to correct these outcomes by furthering the promise of environmental justice.
DEP’s Office of Environmental Justice (OEJ) aims to improve the quality of life in New Jersey’s most vulnerable communities by educating and empowering communities who are often outside of government decision-making processes and guiding DEP’s programs and other state departments and agencies in implementing environmental justice.
