Superintendent Hedalen Responds to Court Decision on Education Savings Account Program
HELENA- The Montana Superintendent of Public Instruction, Susie Hedalen, issued the following statement today in response to the Montana District Court decision striking down part of HB 393 (2023) The Education Savings Account (ESA) program:
“This decision is disappointing, particularly for the families who have benefited from the Education Savings Account program. The ESA program provides important flexibility for families of children with special needs to choose educational settings and supports that best meet their children’s individual needs.
Families participating in the program consistently shared that their children were happier and more successful in their learning. Parents reported significant growth in academic progress and emotional regulation when they were able to access individualized instruction and flexible learning environments. Families also noted that these options reduced stressors such as sensory overload and rigid schedules, allowing their children to thrive.
The Office of Public Instruction respects the role of the judiciary and will review the court’s decision carefully to determine next steps. At the same time, I remain committed to advocating for families and ensuring Montana’s education system supports a range of options to meet the diverse needs of students.”
