Superintendent Celebrates Education Savings Account Win
HELENA – The district court in Helena denied a motion for a preliminary injunction against HB 393, the Students with Special Needs Equal Opportunity Act. This bill, passed during the 2023 legislative session established the Education Savings Account (ESA) for special needs students. The plaintiffs, the Montana Quality Education Coalition and Disability Rights Montana, filed a preliminary injunction to stop the implementation of the ESA during the ongoing lawsuit. To date, the Office of Public Instruction has approved 23 eligible students for the ESA program.
“The court’s decision is a win for Montana students of all abilities and their families,” said Superintendent Elsie Arntzen. “The Education Savings Account offers parents the freedom to choose the best education for their children. Unaccountable bureaucratic associations do not represent the will of Montanans.”
