Title I, Part A carryover limit for SY 2021-22 funds
As SY 2021-22 comes to a close, the OPI is asking districts to review the amount of FY 2021 Title I, Part A funds remaining in their accounts and work to draw down funds by Sept. 30, 2022, to avoid losing those unspent monies due to the 15 percent carryover limitation in ESEA Section 1127(a).
Last fall, the United States Department of Education (ED) published Frequently Asked Questions About Waivers Related to the Title I, Part A Carryover Limitation Under the Elementary and Secondary Education Act of 1965 (ESEA) Due to COVID-19, (OESE 08/16/21). According to that guidance, ED will not provide blanket waivers of the 15 percent carryover limitation for the SY 2021-22 funds that become carryover funds on Oct. 1.
Districts can carry over no more than 15 percent of their annual Title I, Part A allocations under ESEA Section 1127(a), but the OPI can waive the requirement once every three years under ESEA Section 1127(b) for districts with Title I allocations in excess of $50,000. In response to the COVID-19 pandemic, ED provided waivers from the requirement that SEAs could waive the carryover requirement for districts to carry over more than 15 percent of their Title I, Part A allocations only once every three years. This allowed districts to carry over unspent funds from FY 2019 and FY 2020, even if those districts had already applied for and received a waiver for FY 2017 or FY 2018 funds. The FAQ explains that districts that had been granted this carryover flexibility for FY 2020 Title I funds, which became carryover funds on Oct. 1, 2021, will not be eligible for another waiver until FY 2023.
