Employer compliance for nursing mothers

Minnesota law requires all employers to provide accommodations in the workplace for employees who are nursing mothers. The following are some general tips from the Department of Labor and Industry's Labor Standards unit.


Work breaks required

Employers must provide an employee who is a nursing mother with reasonable unpaid break time to express milk for her child. Break times may run concurrently with established employee break times, but employers may be required to provide additional time to nurse if it is requested by the nursing employee.


Room accommodations required

Employers must make reasonable efforts to provide their employees who are nursing mothers a space or room in close proximity to their work area to express milk. The room cannot be a bathroom or toilet stall. The space or room must be: 

  • free from intrusion from coworkers and the public;
  • private and shielded from view; and
  • equipped with access to an electrical outlet.

Employer retaliation prohibited

State law prohibits employers from retaliating against an employee for asserting her rights and remedies under the Minnesota Nursing Mothers Law.
