Policy changes from 2021 legislative session that impact behavioral health


The 2021 Legislature enacted several health and human services policy changes as part of legislation that passed during the regular session (Laws of Minnesota 2021, Regular Session, Chapter 30).  A summary of the legislative changes that impact programs and services for individuals with mental health or substance use disorders is now available on our website.  The legislative summary includes the effective date for each provision and a reference to the bill language. With some exceptions, many of the provisions are effective July 1, 2021. 

Provisions in the legislative summary include:

  • SUD Treatment Program Assessment of Need Modifications
  • Certified Community Behavioral Health Clinic (CCBHC) Modifications
  • Problem Gambling Reporting
  • Problem Gambling Program and Funding Consultation and Recommendations
  • Children’s Mental Health Screening Grants Modification
  • State Advisory Council on Mental Health Membership Modifications
  • Updating Behavioral Health Fund reference to Eligible Vendors of Substance Use Disorder (SUD) Services
  • Updating Treatment Plan Requirement for Intensive Rehabilitation Mental Health Services (IRMHS)
  • Updating Consolidated Chemical Dependency Treatment Fund (CCDTF) to Behavioral Health Fund terminology
  • Mental Health Uniform Services Standards (USS)
  • Temporary Home and Community-Based Services (HCBS) Waiver assessment freeze for people accessing inpatient care
