Oral consent for treatment plans: Children’s Therapeutic Services and Supports (CTSS)

To: Providers of Children’s Therapeutic Services and Supports (CTSS)

A parent guardian’s oral consent may be accepted in lieu of a paper written signature as Individual Treatment Plan (ITP) approval for a child receiving CTSS services. This includes new ITPs and 90-day reviews. A secure electronic signature also is permitted.

Providers must document oral consent in the child’s record and later verify parent approval by obtaining a written signature. No time limit is specified for written verification and a CTSS provider may obtain the parent or guardian’s signature within a reasonable time after the state Stay-at-Home order has been lifted.

Authority exists in current CTSS law: See M.S. §256B.0943, subdivision 6(b)(2)(vi).
