DHS has received questions regarding contracting with the Center for Victims of Torture (CVT):
DHS was asked to clarify if CVT must have a single, contracted rate in the fee-for-service
(FFS) Mental Health Targeted Case Management (MH – TCM) model or whether
different rates may be negotiated with different counties. Minnesota
Statutes, section 256B.0625, subdivision 20 paragraph (f) requires that the
county – negotiated rate must not exceed the rate charged by the vendor for the
same service to other payers. Therefore different rates cannot be negotiated
amongst different counties in the contracting process with CVT.
Another question DHS was asked to clarify is whether or not
county concurrence is required from the county of financial responsibility
prior to the provision of MH – TCM services by CVT to a person who isn’t the
financial responsibility of the contracted lead county. Minnesota
Statutes, section 256B.06, subdivision 4, paragraph (j) requires that the
nonprofit (CVT) must obtain the concurrence of the county of financial
responsibility before providing MH - TCM services to people who aren’t the
financial responsibility of their contracted lead county.
