New Working After Retirement Legislation – Important Update

Public Act (PA) 267 of 2020 was signed into law by the Governor on Dec. 29, 2020, addressing rules concerning working after retirement as a substitute teacher and in a critical shortage position.

Beginning tonight (Feb. 9, 2021), records that were previously suspended due to the critical shortage credit limit will begin to automatically post. Records with a record begin date before Dec. 29, 2020 may still suspend. For these records, use a different class code. Please see the updated Working after retirement – employer guide for the appropriate class code.

In addition, suspended records of retirees in a critical shortage position who retired less than 12 months ago will begin to post. If the record was originally reported with no employer contributions, you may be charged the difference in employer contributions.
