Update on Federal OSHA's COVID-19 Emergency Temporary Standards

Federal OSHA’s COVID-19 Emergency Temporary Standard for Healthcare 1910.502 (ETS1): 

Federal OSHA has not yet rescinded its COVID-19 Emergency Temporary Standard for Healthcare 1910.502 (ETS1) and is using its enforcement discretion to not issue citations of ETS1 until they are officially rescinded. MIOSHA has been informed that OSHA is in the process of rescinding the relevant rules and the agency is preparing updated rules to align with the revised federal rules. Until updates to the rules are made at the federal and state levels, MIOSHA will not issue citations related to Part 505.   

Federal OSHA's COVID-19 Emergency Temporary Standard for Vaccination and Testing 1910.501 (ETS2): 

On January 26, 2022, federal OSHA withdrew its COVID-19 Emergency Temporary Standard for Vaccination and Testing 1910.501 (ETS2). As a result, MIOSHA has not proceeded with the adoption of ETS2. As a reminder, employers are still subject to MIOSHA’s General Duty Clause and are expected to make reasonable efforts to protect their employees from pandemic hazards measured against Centers for Disease Control and Prevention (CDC) guidelines.

MIOSHA and Lawrence Technological University's Construction Safety Research Center invite employers and employees to share a cup of coffee and learn about the importance of workplace safety and health. 

Coffee with MIOSHA events provide an informal opportunity for employers and employees to meet with MIOSHA representatives — including consultative and enforcement — to ask questions, obtain information on program services and resources, learn about MIOSHA Training Institute opportunities and establish rapport.

Reminder to Employers: Report 2021 Injuries and Illnesses

As a reminder, Michigan employers are required to post the total number of job-related injuries and illnesses that occurred in 2021. The information gathered from these logs greatly benefits employers, workers and MIOSHA in evaluating the safety of a workplace and making the necessary changes to eliminate hazards.

MIOSHA requires most Michigan employers with 11 or more employees to log and maintain these records and make sure they are available in the event of an investigation.

These records include:

In accordance with this requirement, employers must post the MIOSHA Form 300A in their establishments from Feb. 1 to April 30, 2022.

Any employer with 250 or more employees, in industries that are required to maintain injury and illness logs, and employers in a select group of industries with 20 to 249 employees, must electronically submit MIOSHA Form 300A data to federal OSHA between now and March 2, 2022. Michigan Worker Deaths of 2022

To date, there have been two work-related fatalities reported to MIOSHA in 2022. The information below shares preliminary details about the most recent fatalities reported to MIOSHA which are believed to be covered by the MIOSH Act. The description reflects information provided to MIOSHA at the initial report of the incident and is not the result of the official MIOSHA investigation.

Preliminary summaries of the most recent 2022 incidents:

A 29-year-old steel laborer was operating an extendable boom forklift to pick up pre-insulated metal panels when he leaned through the cab and was crushed by the lift boom.

A 61-year-old loader operator had a hydraulic line break. As he attempted to replace the hydraulic line, he loosened the wrong line and the load came down on him, crushing him against the axle.
