USMCA Update

In 2018, Canada and Mexico were Michigan’s top export markets at $902 million and $174 million respectively. The USMCA (United States-Mexico-Canada Agreement), the free trade agreement that has been created to replace NAFTA (the North American Free Trade Agreement), was drafted in 2018 to ensure that U.S. food and ag producers maintain preferential market access in Canada and Mexico and to ensure a commitment to fair trade.

 

The agreement is very similar to NAFTA and will not change the free trade landscape drastically. However, there are some key provisions that have been changed. Some of these include:

  • Giving American businesses greater duty-free access to the Canadian dairy market.
  • Enforceable labor requirements requiring Mexico to improve collective action bargaining and requirements for in-country automobile manufacturing.
  • The addition of a sunset clause, ending the agreement in 16 years.

On November 30, 2018, leaders from all three countries signed the deal, but each country must follow its own domestic procedures before it will be officially ratified.

 

On June 20, 2019, the Senate of Mexico ratified the agreement, and Mexico’s part will be complete when its president announces ratification in the Federal Register.

 

Canada, on September 11, 2019, declared the dissolution of the Canadian Parliament under parliamentary election law. On October 21, 2019, the parliamentary election will take place and the USMCA will be brought before the new assembly.

 

In the U.S., ratification is still being worked on in the House. On September 26, it was confirmed that the House was proceeding on work with USMCA. House Democrats have voiced concern over some areas they’d like to see changed, but Mexico and Canada have stressed that they will not renegotiate the agreement. If the USMCA passes in the House, it will be sent to the Senate where the Republican majority is expected to ratify it quickly.
