Marshall County Couple Plead Guilty to
Insurance Fraud
Investigation by Kentucky DOI Results in
Criminal Charges
FRANKFORT, Ky. (May 22, 2018) - A Marshall County couple have plead guilty to several criminal charges
in connection to an investigation conducted by the Kentucky Department of
Insurance’s (DOI) Division of Insurance Fraud Investigation.
Tim and Becky King, owners of Filbeck-Cann & King Funeral Home in
Benton, pleaded guilty to two counts of fraudulent insurance acts (over $500),
one count of theft by unlawful taking or disposition ($500-$10,000), one count
of criminal possession of a forged instrument, and two misdemeanor counts of
fraudulent insurance acts ($500 or less).
In February 2017, DOI began investigating allegations of life
insurance policies sold as burial pre-arrangements by unlicensed individuals,
and stolen premiums for those policies. The investigation revealed the
funeral home had a licensed insurance agent on staff, but the Kings sold
policies, forged the agent’s name on documents, and stole premiums totaling
$3,121,783.27 on 72 policies from 2007 to 2016.
“Policyholders trusted that they would be covered during a difficult
time and they were exploited. I commend the investigators of the Division of
Insurance Fraud Investigation for their diligence in helping to bring justice
to these families,” said DOI Commissioner Nancy G. Atkins.

insurance fraud using the online Uniform
Suspected Insurance Fraud Reporting Form. Consumers can also use
DOI’s website to search for the license status of an agent or agency.
