FY 2021 Declaration of Participation Notification - DEADLINE EXTENDED TO APRIL 13

It is time for the Declaration of Participation Report to be completed by your district in accordance with the Every Student Succeeds Act (ESSA). This report is used to identify the number of students enrolled in area private nonprofit and home schools. Federal programs participating in the Declaration of Participation are Title II-A Supporting Effective Instruction, Title IV-A Student Support and Academic Enrichment Grants and IDEA-B – Individuals with Disabilities Education Act.

In addition to the programs listed above, the Kentucky Department of Education (KDE) has designed a separate form for the Title III – Language Instruction for English Learners (EL) and Immigrant Students program. This form will be used to identify the number of English learner students and the number of immigrant students enrolled in area private nonprofit and home schools.

Section A of the Title III – Language Instruction for English Learners (EL) and Immigrant Students form is the only collection tool being used to denote your district’s intent to participate in the program either directly or in a consortium.

You are asked to list all private nonprofit schools and all home schools that are physically located in your school district’s geographic boundaries, not just those participating. Include memberships of all private schools and all home schools, regardless of whether they will participate or are eligible to participate in the above programs in 2020-2021. A grand total of the participants in each program also is required. Do not include private schools or home schools located outside your district's boundaries that are required to be contacted for Title I services.

Because participating private school and home school membership data directly impacts the per pupil dollar amount allocated to the public school districts for Title III-EL/Immigrant, and IDEA-B, it is critical that these totals be accurate. Public school membership information is already on file in the KDE (per School Data Forms) and should not be included.

According to federal law, only private schools having an official nonprofit status are eligible to receive services under Title II-A, Title III-EL/Immigrant, Title IV-A and IDEA-B. Any private school wishing to participate in such programs must have filed articles of incorporation with the office of the Kentucky Secretary of State as a nonprofit corporation under KRS 273 or have received a letter from the IRS granting them 501(c)(3) status as a nonprofit corporation. Home schools, by their nature, are considered nonprofit.

A signed assurance statement verifying an official nonprofit status must be filed with the respective local educational agency (LEA) for each private school or home school wishing to participate in Title II-A, Title III-EL/Immigrant, Title IV-A or IDEA-B. See the nonprofit compliance statement on the Private, Non-Profit (PNP) School Declaration of Participation for Title II-A, a Title IV-A and IDEA-B form located on the website. Of the three compliance statements, a school official must have checked “no” for the first two and “yes” for the third in order to participate in any of the programs. Just checking the program in which the school wishes to participate does not make the school eligible to participate.

The signed individual Private, Non-Profit (PNP) Schools and Home Schools Declaration of Participation for Title IIA, Title IV-A and IDEA-B assurance forms and the Private, Non-Profit (PNP) Schools and Home Schools Declaration of Participation for Title III-EL assurance forms are to be retained at your district office rather than copied and submitted to KDE. Documentation that you have corresponded with private schools and home schools physically located in your school district’s geographic boundaries to offer them the opportunity to participate must be kept on file locally. Please copy the forms as needed.

KDE has made the Title IX, Part E Uniform Provisions Subpa​rt 1 – Private Schools guidance available. This guidance is intended to assist local educational agencies and other entities in fulfilling their obligations under ESSA to provide equitable services to eligible private school students, teachers and other educational personnel, and under some programs, to parents. This guidance does not impose any requirements beyond those in the law. Districts are encouraged to print this document and share it with all federal program coordinators and private school contacts. It should be noted that although this guidance document was produced under the No Child Left Behind Act, the U.S. Department of Education considers the principles within to be valid, unless otherwise stated. 

By April 13, completed Declaration of Participation Report forms indicating the public LEA’s intentions and summarizing the private and home schools’ Declarations of Participation forms should be emailed to Thelma Hawkins.

How can I provide supplementary EL services to students during school closures caused by COVID-19?

You might find yourself wondering how to serve English learner (EL) students during these unprecedented times of school closures caused by the spread of COVID-19. The Kentucky Department of Education (KDE) has gathered some EL-related online resources shared by the Illinois Board of Education that you might find helpful.

Please note, these resources may not meet the criteria for Non-Traditional Instruction (NTI) Program coursework, but could be good supplemental resources anyway.

KDE has reached out to U.S. Department of Education with questions and for additional guidance on best practices in serving EL students while schools are closed and utilizing NTI days. Free Resources for Schools to Help Provide E-learning to English Learners

Resources shared in this email are not endorsed by the Kentucky Department of Education and are provided for informational purposes only.

The National Council of State Supervisors for Languages (NCSSFL) is collaborating to provide a single site to locate resources to assist schools in the move to remote learning. Anyone with the link can view the spreadsheet and download it to use as needed.  The resource bank will be updated regularly as new resources are located. 

The spreadsheet is organized into four tabs:

  • COVID-19 U.S. and State Resources: Information shared by national, regional and state organizations about the COVID-19 situation, specifically for K-12 schools;
  • Technology Resources for Teaching World Languages Online: Resources and information about moving world language instruction online;
  • Multilingual Resources: Websites and other online resources that have materials and activities that could be adapted for a variety of world languages, such as CASLS Games2Teach website; and
  • Language-Specific Resources: Websites and online resources that are for one world language, such as free online Spanish books.

IMPORTANT DATES, DEADLINES & ANNOUNCEMENTS

 

New Home Language Survey template available

The fall 2019 newsletter included an article explaining the home language survey (HLS) all districts are required to administer upon each student’s initial enrollment into grades K-12. An HLS template created by the Kentucky Department of Education (KDE) is available on the English Learner and Immigrant Resources webpage.

The HLS template includes the four questions required by Section 3113(b)(2) of the Every Student Succeeds Act (ESSA), 703 KAR 5:070 and the related Inclusion of Special Populations Guidance. The template also provides an explanation of the document to help parents understand the purpose of the survey, to identify the true linguistic status of the student and to reduce the number of incorrect completions. Districts are not required to use the new template; however KDE is encouraging its use to increase consistency in English learner (EL) identification across the state.

The responses on the HLS do not directly affect a student’s EL status. Only a WIDA screener can classify a student as an EL and only a score meeting the state’s exit criteria on the WIDA ACCESS or Alternate ACCESS can remove a student’s EL classification.

 

Tentative allocations, Intent to participate and GMAP

The Kentucky Department of Education's Division of School and Program Improvement is experiencing delays due to the unprecedented COVID-19 closures of schools across the Commonwealth. All information, such as tentative allocation amounts and an application timeline, is forthcoming.

The English learner (EL) extract for tentative allocations will be run on March 27. Once tentative allocations are available to view in GMAP and the intent to participate opens, KDE will notify Title III coordinators by email using the contacts listed in Person Role Manager.

 

Kentucky Coalition for English Learners Summer Conference set for June 15-16

Save the date for the second annual Kentucky Coalition for English Learners (KyCEL) Summer Conference, which will be June 15-16 at the Muhammad Ali Center in Louisville.

The theme for the 2020 Summer Conference is “Building Bridges,” with keynote speakers Alba Ortiz and Margaret Heritage. Ortiz is a well-known expert in distinguishing language differences from disabilities. Heritage is a national thought leader in the area of formative assessment.

A preconference workshop on the morning of June 15 will address issues related to social-emotional health and mental health in refugees.

The registration fee for the 2020 KyCEL Summer Conference is $175 for the full conference and $75 for the pre-conference. Registration details will be released soon.

 

Tentative dates for summer EL and Title III coordinator training

Save the dates for our annual EL and Title III Coordinator training tentatively scheduled for June 22- 26.  All dates and locations are open for anyone in case you cannot attend a date and location closest to you. The trainings will be at various locations around the state 9 a.m.-4 p.m. local time. Specific locations and registration links are forthcoming.

Please note: Due to the unforeseen circumstances with COVID- 19, these dates and locations are tentative and could change.
