Greetings County/Local Agencies,
Does your agency get records requests from the public? And do you know how to respond?
I spoke with Luke Britt, Indiana's Public Access Counselor, about the basics of responding to public records requests and here is what he had to offer:
Once you receive a request, the burden shifts to the agency to respond in some way, to acknowledge it.
- If a remote request is sent via email, fax, or mail, the agency has 7 days to acknowledge receipt.
- If its an in-person request, the agency has 24 hours to acknowledge receipt.
After the acknowledgement, there is a reasonable time on a case-by-case basis to deny or process the request.
