Good morning County/Local Agencies,

Several Clerks have asked me about marriage records. Located on the CL retention schedule, marriage records are PERMANENT and CRITICAL.

Record Series: CL 13-01

Title/Description: MARRIAGE RECORDS: Includes Application for Marriage License, Record of Marriage, Marriage Index, Marriage Licenses and other related records. [Applications for Marriage may be PARTIALLY CONFIDENTIAL beginning in 1958. Disclosure of these records is subject to IC 5-14-3-4(a)(12) and IC 5-15-6-7(c)(6)]. THIS IS A CRITICAL RECORD.

Retention Period: PERMANENT. Microfilm according to 60 IAC 2 standards. Original may be retained in office or transferred to the Indiana State Archives pursuant to IC 5-15-6-6 at such time as record no longer has official value but has historical value.

Record series whose descriptions state "THIS IS A CRITICAL RECORD" must always be transferred to microfilm if the original format makes that possible, with one copy of the microfilm located at the originating office, and the original roll or negative transferred to the Indiana Archives. Original paper records may be destroyed after verification of the microfilm for completeness and legibility. If your original CRITICAL records are in electronic or audiovisual format, contact IARA's Electronic Records Program (erecords@iara.in.gov) to determine the best method of preservation and transfer to the Indiana Archives.
