Note: The Legislative Action Alert is a new service implemented by the Iowa Department of Education to inform stakeholders of enacted legislation that requires the immediate attention of the field and will be issued periodically throughout session.
----
Governor Reynolds signed Senate File 482 on March 22, 2023. The bill is effective upon enactment, so school officials must attend to its requirements immediately.
This bill requires elementary and secondary public and nonpublic schools to designate multiple occupancy restrooms and changing areas to be used only by persons of the corresponding biological sex. Individuals are prohibited from entering a single or multiple occupancy restroom or changing area that does not correspond with the person’s biological sex. The bill allows school officials to provide alternative facilities to a student upon request with written consent of the parents, provides what reasonable accommodations may include, and provides enforcement mechanisms.
Please reach out to local counsel if you have any questions. Again, this law is now in effect.
