Effective October 1, 2014, new adjudication laws will take effect under the Traffic Adjudication Amendment Act of 2014. With this new law, customers will have 30 days after a liable decision has been rendered from their initial hearing to submit a request for reconsideration online or by mail. They will be allowed to submit new information for the hearing examiner to review. If the liable decision is upheld, then customers may appeal the decision to the Traffic Adjudication Appeals Board (TAAB). However, customers must file a request for reconsideration before they can file an appeal to TAAB.
Customers may also file a Motion to Vacate when the ticket has not been answered within 60 calendar days and a deemed admission was entered, or the ticket was answered and the customer failed to appear at an in-person hearing, so a default judgement was entered. Customers have 30 days from when the deemed admission was entered to file a Motion to Vacate unless their citation falls under one of the three exemptions:
- Distracted Driving - first time cell phone violation
- Operating without Insurance
- Defense to parking or photo enforcement ticket is that the vehicle is not theirs, or the tags were lost or stolen when the ticket was issued
If the violation is one of these three exemptions, then customers have 365 days to file a Motion to Vacate.
More details will be available on DC DMV's website beginning October 1, 2014. If you have questions, tweet us or send a Facebook message.
All DC DMV locations will be closed on Saturday, October 11 and Monday, October 13, 2014 in observance of Columbus Day. Regular hours will resume on Tuesday, October 14. High volume is expected at all DC DMV locations before and after the holiday, so please plan accordingly. Enjoy!
Beginning October 1, 2014, customers must file a request for reconsideration before filing an appeal unless the hearing examiner denied a Motion to Vacate. So, here's the process for adjudicating a ticket:
-
Submit request for adjudication online, through the mail, or in person. Provide supporting documents and/or pictures.
- Wait for a decision to be rendered on the request for adjudication.
- Submit a request for reconsideration (online or by mail only) if you are held liable for the ticket. Submit new documents and/or pictures for the hearing examiner to review.
- Complete and mail in the appeals application and required fines and fees if your decision of liable is upheld. You must file a request for reconsideration before filing an appeal.
Always submit supporting documentation (i.e., pictures, vehicle registration, etc..) with your initial request for adjudication.
