New CBEI Template and New CDFW Specific Bank Proposal Best Practices Published - May 1, 2026 |

New Conservation Bank Enabling Instrument Template
The wildlife agencies, in conjunction with the Water Board of the Project Delivery Team (PDT), have developed and finalized the new 2026 Conservation Bank Enabling Instrument (CBEI) template. The template is located on the CDFW banking webpage.
Please note:
- Bank Sponsors will need to use the new 2026 CBEI template on or after May 28, 2026, for a conservation bank.
- If a Bank Sponsor wants to incorporate language from the 2026 CBEI template into an already signed CBEI, the request will be considered a complex amendment. Amendment documents along with a Complex Amendment Fee will need to be submitted to CDFW.
- If a Bank Sponsor wants to use the 2026 CBEI template for an already submitted draft CBEI, the Bank Sponsor will be allowed to do so without incurring a fee.

New CDFW Specific Bank Proposal Best Practices Document
CDFW is providing a best practices document as a tool for Bank Sponsors to use to decrease delays and to address common issues CDFW finds during bank review.
This is not an exhaustive list but rather a summary of items seen over the years that have caused delays. Bank Sponsors should refer to relevant state and federal banking statutes, guidelines, checklists, etc.
