Request for Input on California Multi-Agency Mitigation Bank Conservation Easement Template

The purpose of this notice is to solicit comments from interested parties to support the revision of the March 17, 2017 version of the California Conservation Easement (CE) Deed template. This document is located on the Conservation and Mitigation Banking Instructions and Templates page of the CDFW banking website.
The California Department of Fish and Wildlife (CDFW), along with the U.S. Army Corps of Engineers’ (USACE), the U.S. Fish and Wildlife Service (USFWS), the California Natural Resources Agency (CNRA), the National Marine Fisheries Service (NMFS), the United States Environmental Protection Agency (EPA), the State Water Resources Control Board (State Water Board), and the Natural Resources Conservation Service (NRCS), as potential participants in Interagency Review Teams (IRTs) and Conservation Bank Review Teams (CBRTs), collectively known as the RT agencies, are updating the March 17, 2017, California Interagency CE template.
Pursuant to the 2011 Memorandum of Understanding Concerning Mitigation and Conservation Banking and In-Lieu Fee Programs in California, the RT agencies are proposing to jointly revise the California Interagency CE template to incorporate updates based on lessons learned and address changes in land trust requirements. The RT agencies have committed to establishing a combined and coordinated approach to mitigation banking in the State of California, which includes development of and regular updates to RT-approved template documents. This notice is being circulated prior to starting the revision process to update the Conservation Easement template. CDFW will send another notice after the revised CE template is finalized.
