New Checklists Available

The new August 2025, California Interagency Mitigation and Conservation Banking checklists are now available on the Conservation and Mitigation Banking Instructions and Templates page of the CDFW Conservation and Mitigation Banking public website.  Previously this was one larger combined document, but it has been broken out into three distinct checklists based on which stage a bank is in. The draft prospectus checklist can be found under the Draft Prospectus (Optional) section, the prospectus checklist can be found under the Prospectus section, and the draft BEI/CBEI checklist can be found under the Bank Agreement Package section.

The Project Delivery Team (PDT) established by the 2011 interagency Memorandum of Understanding (MOU) concerning Mitigation and Conservation Banking and In-Lieu Fee Programs in California has updated the California Interagency Mitigation and Conservation Banking checklists, following the consideration of internal and external comments received, and following input from the Bank Agency Management Team (BAMT), also established by the MOU.

Bank sponsors submitting a new draft prospectus, prospectus, draft Bank Enabling Instrument (BEI), or draft Conservation Bank Enabling Instrument (CBEI) on or before September 01, 2025 may continue to use the April 2024, California Interagency Mitigation and Conservation Banking checklists. Bank sponsors must use the August 2025 checklists when submitting a new draft prospectus, prospectus, draft BEI, or draft CBEI after September 01, 2025. This requirement does not apply to the submittal of revised BEIs or CBEIs addressing Interagency Review Team or Conservation Bank Review Team comments, where the initial draft BEI or draft CBEI was submitted on or before September 01, 2025. However, banks currently in process may, and are encouraged to, use the August 2025, California Interagency Mitigation and Conservation Banking checklists, rather than earlier versions. When to use the August 2025 checklists are outlined in the table below:
