REMINDER: Construction General Permit Transition Deadline: Take Action By August 31, 2025.
Public Notice: Construction Projects
All active construction projects operating under the State’s 2009 Construction General Permit (CGP) must transition to coverage under the 2022 CGP by September 1, 2025. Projects not transitioned by this date will be automatically terminated and must reapply to resume construction. This includes projects permitted under the 2009 CGP that have not been officially closed-out by the State.

How this Might Apply to Your Project
If your construction project has been using a 2009 WDID number and the project will not be complete (i.e., a Notice of Termination has not been filed) by August 31, 2025 the Legally Responsible Party (LRP) must do the following to stay in compliance:
- Apply for coverage under the 2022 CGP via the Stormwater Multiple Application and Report Tracking System (SMARTS): The LRP must electronically submit Permit Registration Documents (PRDs) via SMARTS. PRDs consist of the NOI, Risk Assessment, Post-Construction Calculations, a Site Map, the SWPPP, a signed certification statement by the LRP, and the first annual fee
- Pay the application fee.

Attention 2009 CGP Legally Responsible Persons and Duly Authorized Representatives
If your project is complete but you have not filed a Notice of Termination (NOT) to SMARTS by August 31, 2025, you will be required to apply for 2022 CGP coverage by submitting a new Notice of Intent (NOI).
Act Now to Ensure Compliance
Projects that do not have a new WDID number by September 1, 2025, must STOP all construction activities until a new WDID number is issued. Act now to avoid project delays.
