  Dear Permittees,
Effective Wednesday, April 7, 2021, San Diego County has moved to the Orange Tier, or Tier 3. Below is a brief summary of allowable operations with modifications in the Orange Tier or Tier 3:
- Restaurant indoor dining (maximum 50% capacity or 200 people, whichever is fewer), outdoor dining, drive-thru, take-out, pick-up, and delivery
- Includes the removal of the curfew that previously required restaurants to stop accepting customers at 10:00 pm
- Wineries, breweries, and distilleries take out, pick up, delivery, outdoor dining, and open indoors with the modifications below:
- Maximum 25% capacity indoors, or 100 people, whichever is fewer
- A meal is not required to be served at wineries, breweries, and distilleries when operating within the stated modifications
- Bars without food are allowed to conduct only outdoor service, with modifications. Bars that serve a meal, can continue to comply with the restaurant requirements
- Shopping centers, including swap meets, open indoors with no capacity restrictions; however, common areas remain closed and food courts must follow reduced capacity restaurant requirements listed above
- Gyms and fitness centers, open indoors at a 25% maximum capacity and indoor pools are allowed to reopen. Indoor hot tubs / spas, saunas and steam rooms must remain closed
- Museums, zoos, aquariums, open indoors with 50% maximum capacity
- Body art facilities and massage establishments may continue offering indoor services with modifications outlined in the State’s COVID-19 Industry Guidance for Expanded Personal Care Services.

Review your onsite Safe Re‐opening Plan or Food Facility Protocols, and if necessary, update it to be consistent with the new requirements.
