On Sunday, Dec. 20, 1936, Herman Lanszus and John Chernoh of Sacramento were arrested in Auburn for picking Toyon berries without a permit.
The bright red berries were popular decorations for Christmas. The Toyon shrub, Heteromeles arbutifolia, also commonly called “California Holly”, was so popular that it was threatened. From Los Angeles to northern California, the shrub was disappearing.
Some people began to cultivate Toyon and sell the ornamental berries for the holidays to save the shrub in the wild, but it wasn’t enough. In the 1920s, several laws were passed in California making it illegal to damage the shrub or to pick the berries without a permit or permission from the landowner. If caught, one could be fined up to $500, which was a hefty fine for the time.
Today, the evergreen Toyon is used by gardeners and landscape designers to add color in the winter, and it remains a popular Christmas berry for wreaths and garland.
