Napa Cove Updated Combined Notice: Notice of Finding No Significant Impact (FONSI) and Notice of Intent to Request Release of Funds
This notice shall satisfy two separate but related procedural requirements for activities to be undertaken by CRP Affordable Housing & Community Development.

REQUEST FOR RELEASE OF FUNDS
On or after the end of the comment period (January 30, 2022), the City of American Canyon will authorize the Housing Authority of the City of Napa to submit a request to the U.S. Housing and Urban Development Department (HUD) for the release of HUD’s Project-Based Vouchers funds under the Quality Housing and Work Responsibility Act of 1998, as amended in 2000 by the Fiscal Year 2001 Appropriations Act, in 2008 by the Housing and Economic Recovery Act, and 2016 by the Housing Opportunity Through Modernization Act to undertake a project known as Napa Cove Apartments (Project) for the purpose of utilizing 8 Project Based Vouchers at the Napa Cove Apartments in the City of American Canyon.
CRP Affordable Housing & Community proposes to construct the Project located at 3805 Broadway, American Canyon, Napa County, California 94503 (Accessor Parcel Numbers (APNs) 058-362-005, 058-362-016, and 058-362-021). The 66 dwelling-unit Project consists of three two – to three-story residential buildings, a leasing office, and 119 parking spaces. The Project will be 100 percent affordable.
FINDING OF NO SIGNIFICANT IMPACT
The City of American Canyon has determined the Project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional Project information is contained in the Environmental Review Record (ERR) (Napa Cove Apartments Environmental Assessment) on file at the City of American Canyon Community Development Department located at 4381 Broadway Street, Suite 201, American Canyon, CA 94503 and may be examined or copied weekdays 9 A.M. to 5 P.M. All comments received by January 30, 2022, will be considered by the City of American Canyon prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.
ENVIRONMENTAL CERTIFICATION
The City of American Canyon certifies to HUD that Brent Cooper in his capacity as Director of Community Development at the City of American Canyon consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows CRP Affordable Housing & Community Development to use Program funds.
OBJECTIONS TO RELEASE OF FUNDS
HUD/California will accept objections to its release of funds and the City of American Canyon’s certification for a period of fifteen calendar days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of American Canyon; (b) the City of American Canyon has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD/California; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be emailed to todd.r.greene@hud.gov. Potential objectors should contact todd.r.greene@hud.gov to verify the actual last day of the objection period.
