Before becoming an attorney, Ms. Kim worked for 11 years in the Superior Court of San Diego County, primarily in the Probate Division as a Probate Examiner. Ms. Kim is bilingual in Korean and English.

California's Private Attorneys General Act (PAGA)

California’s Private Attorneys General Act (“PAGA”) allows workers to bring representative actions for Labor Code violations.

•This panel will explore the ever-changing PAGA landscape, and offer insight into how best to handle PAGA litigation

.•The speakers will provide both introductory and higher level discussion regarding what PAGA is, what violations give rise to PAGA liability, how PAGA claims are brought and litigated, and what remedies are available through PAGA

.•They will also explore issues that arise when PAGA claims are subjected to motions to compel arbitration, as well as aspects of settlement of PAGA claims.

About the Speakers:

Hunter Pyle graduated from Boalt Hall School of Law (UC Berkeley) in 1997. He has represented clients in wrongful termination/discrimination cases against such entities as Chevron, Georgia-Pacific, and the California Department of Transportation (Caltrans). Mr. Pyle has served as the Chair of the Alameda County Bar Association Labor and Employment Committee.  In addition to practicing law full time, he is a Lecturer at Berkeley Law School where he teaches the Employment Law course to 2nd and 3rd year law students.

Catha Worthman is a founding partner at the firm Feinberg, Jackson, Worthman & Wasow in Berkeley, CA. Through her public interest practice involving class actions, multi-plaintiff cases, and individual litigation, Catha advocates for the rights of workers, retirees, and people with disabilities.  She has litigated cases involving the full range of ERISA and employee benefits issues, including breach of fiduciary duty, ESOP, pension, healthcare and long-term disability benefits, as well as wage and hour and disability rights cases.

Employment Law Update: A Closer Look at COBRA

Program Description: COBRA – the Consolidated Omnibus Budget Reconciliation Act – requires group health plans to offer continuation coverage to covered employees, former employees, spouses, former spouses, and dependent children when group health coverage would otherwise be lost due to certain events.

This program will discuss the nuances of COBRA, common pitfalls and tips for compliance. Topics include:
• Which employers are subject to COBRA and who is considered a qualified beneficiary
• COBRA qualifying events and duration of coverage
• COBRA notice requirements
• Interaction between COBRA and Medicare
• COBRA and business reorganizations
• Coordination of COBRA and Family Medical Leave Act (FMLA)

About the Speaker: Cristina A. Collazo, Esq. is a Senior Benefits Advisor at the US Department of Labor, Employee Benefit Security Administration (EBSA).  As a Senior Benefits Advisor, Cristina provides technical assistance to employers, employees, and service providers in private sector retirement and welfare benefit plans. She also conducts outreach and education in various states on the Employee Retirement Income Security Act (ERISA) and other federal laws related to employee benefits.

Real Property: Financing Remedies

This program will familiarize learners with the options and opportunities available when a loan secured by real property is in default.

  • What constitutes a default under the note?
  • Appropriate remedies depend on both the type of default and property
  • Trustee sale, aka nonjudicial foreclosure
  • Judicial foreclosure
  • Role of loan servicers
  • Guarantors and sureties - liability, defenses, and Gradsky waivers

This is a basic level program and assumes no prior experience in real property law. Appropriate for attorneys new to real property law, as well as those seeking a refresher.

About the speaker: Steven M. Morger is an experienced business litigator who represents clients involved in real estate and complex business disputes.  He has particular expertise in the areas of mortgages, deeds of trust, foreclosure and anti-deficiency issues, as well as guarantees and UCC.personal property-secured transactions.  He has also taught at the University of California, Berkeley, School of Law and has provided expert testimony involving real estate secured transactions and guarantees as well as title insurance, escrow and related disputes.  He works with all aspects of civil litigation and discovery through trial and appeal   Mr. Morger has counseled cannabis industry clients on lease and financing transactions and defended property owners in claims brought by federally chartered banks based on medical dispensary issues
