Judge rules on CD8 Special Primary signature challenges, overseas and military voters to receive new ballots

A Maricopa County judge ruled Tuesday that a candidate in Congressional District 8 Special Primary Election should be removed from the ballot for not providing enough valid signatures to qualify for the ballot. The decision required that Gene Scharer’s name not be included in this election.

The plaintiff withdrew a separate case challenging the validity of the signatures that candidate Brianna Westbrook submitted. Signature challenges were filed with the court on Thursday, January 18.  

On Jan. 12, the Maricopa Elections Department, following direction from the Department of Justice, sent 153 Democratic primary ballots to overseas and military voters. Democratic voters returned six of those ballots. Instructions included on the ballot indicated that the candidate roster was subject to change. The Maricopa Elections Department revised and resent the Democratic Primary ballots to reflect the changes to the candidate list to 151 voters. Two of the 153 voters have moved back in county. Additionally, the six voters who already returned their ballots will receive new, updated ballots.

The Elections Department will hold the initial ballots returned by the Democratic overseas and military voters until the voters return the new, updated ballot. If the voters do not return the second ballot, the first ballot will be processed.

Congressional District 8 is having a special election to fill a vacancy that occurred more than six months before the regularly scheduled election. The Primary Election will be held on February 27, 2018 and the General Election will be held on April 24, 2018. Juez emite fallo sobre la impugnación de firmas en la Elección Especial Primaria CD8 para que votantes en el extranjero y militares reciban nuevas boletas

Un Juez del Condado de Maricopa emitió su fallo el martes de que un candidato en la Elección Primaria Especial del Distrito Electoral 8 del Congreso debería ser eliminado de la boleta por no proporcionar suficientes firmas válidas para calificar para la boleta. La decisión requirió que el nombre de Gene Scharer’s no se incluyera en esta elección.

El demandante retiró el caso por separado de impugnación de validez de las firmas que presentó la candidata Brianna Westbrook. La impugnación de firmas fue presentada ante el tribunal el jueves 18 de enero.

En enero. 12, el Departamento de Elecciones de Maricopa, siguiendo instrucciones del Departamento de Justicia, envió 153 boletas primarias del partido democrático a votantes extranjeros y militares. Los votantes democráticos devolvieron seis de esas boletas. Las instrucciones incluidas en la boleta indicaban que la lista de candidatos estaba sujeta a cambios.
