CMS Guidance for Staff Vaccination

DBH eMemo important new for you

The State is still reviewing the implications of the U.S. Supreme Court staying the enforcement of two preliminary injunctions that has stopped CMS from implementing and enforcing its vaccine requirement for certain facilities and providers who receive CMS funds on January 13.  CMS has issued guidance on the timeline for enforcement for facilities and providers in the 25 states, including Alaska, that were not subject to the compliance phases published on December 28, 2021. That guidance is available here:  https://www.cms.gov/files/document/qso-22-09-all-injunction-lifted.pdf and the attachments it refers to are available here: https://www.cms.gov/medicareprovider-enrollment-and-certificationsurveycertificationgeninfopolicy-and-memos-states-and/guidance-interim-final-rule-medicare-and-medicaid-programs-omnibus-covid-19-health-care-staff-0. In the meantime, we highly recommend you seek advice from your own legal counsel since the State of Alaska cannot provide any definitive legal advice for providers.
