Update for BRS, RSS, CCSS and CSR for Sunsetting Codes

DBH eMemo important new for you

Dear Providers,

We have heard from some of you about your experience transitioning to the 1115 waiver.  The Division would like to notify providers that March 31, 2021 represents the sunset date for federal reimbursement only and until state regulations removing these services become permanent, providers may continue to bill for these services at this time.

The regulatory package to repeal these services has not been finalized, so you may still submit claims for these services at this time and we will pay those claims with state general funds.

Please be clear that the submission of claims and payment for these services will not be available once the regulations that repeal these services and which are currently out for public comment are made finally adopted by the Commissioner and signed by the Lt. Governor.  At this point we do not have a date certain on when the repeal of these regulations will be final. Please note the repeal will become effective 30 days after the Lt. Governor’s signature.  Once that happens, you will no longer be able to bill for these services. We will provide you with updates on the status of the repeal of these services so that you know when state funding for these services will no longer be available.

I hope that information takes a bit of pressure off while we continue to identify a path forward for the emergency shelter program.  if you have any questions or concerns please don’t hesitate to reach out to me.

Gennifer Moreau,

Director, Division of Behavioral Health
