Section 1115 Waiver Update e-Memo

As most of you know, the Department is considering filing the regulations that will govern Medicaid 1115 waiver services as Emergency Regulations, with the intent to permanently adopt.  We wanted to provide everyone with an understanding of how emergency regulations are processed and the expected time-frame involved.  Attached are two documents that depict the process and required time-line.  The most important take-away is that emergency regulations must still follow the standard adoption process to be made permanent.  This will involve public comment and an oral hearing.  The Department may amend the emergency regulations based upon the comments received through this process.

 

The Division will do its best to keep everyone informed and updated on the waiver regulations.
