Job Summary:
This position is located in the Washington, DC National Office (NO) with the Final Adjudication Branch (FAB), Division of Energy Employees Occupational Illness Compensation (DEEOIC), Office of Workers Compensation Programs (OWCP) of the U.S. Department of Labor (DOL). The mission of DEEOIC is to administer the benefits provisions of the Energy Employees Occupational Illness Compensation Program Act (EEOICPA), 42 U.S.C. 7384 et seq. , as mandated by Executive Order 13179, dated December 7, 2000. The EEOICPA provides compensation and medical benefits for covered workers who sustain certain employment-related illnesses as a result of exposure to beryllium, ionizing radiation, and other hazards unique to nuclear weapons production and testing. This position is that of workers compensation claims examiner/hearing representative with responsibility for reviewing recommended decisions issued by the district office, conducting hearings when requested, and drafting final agency decisions, which are subject to federal court review, on cases dealing with the complete range of EEOICPA occupational illness claims, including those of exceptional complexity. The employee must routinely weigh evidence and exercise sound legal judgment on the disposition of the case. The employee must exercise sound judgment and discretion in conducting hearings that involve a variety of claimants and their representatives. The employee must clearly articulate factual and legal reasons for the denial of a claim so that it is upheld by any federal district court reviewing the FAB decision. The majority of the employees decisions are issued as drafted with no further review by management and with the signature of the employee.
