Upstate New York man sentenced to 70 years in prison for production and possession of child pornography

BUFFALO, N.Y. — An upstate New York man, who was convicted for production and possession of child pornography, was sentenced to 70 years in prison and a lifetime of supervised release. The sentence is the result of an extensive investigation by U.S. Immigration and Customs Enforcement's (ICE) Homeland Security Investigations (HSI).

Roger S. Luczkowiak, 32, of Dunkirk, N.Y., was sentenced to 70 years in prison and a lifetime of supervised release by Chief U.S. District Judge William M. Skretny.

According to court documents, the Dunkirk (N.Y.) Police Department and New York State Police seized a computer from the defendant's residence June 1, 2011. A forensic analysis of the computer found multiple images and videos of child pornography, including two videos that appeared to be produced by the defendant at his home with a six-year-old victim. Some of the images included the victim and the defendant. The defendant also possessed nearly 600 images and over 80 videos of child pornography.

"The production of child pornography is a truly despicable act that could have lifelong effects on children," said U.S. Attorney William Hochul, Western District of New York. "Fortunately, this predator will now likely spend the rest of his natural life behind bars as a result of his actions. Our office will continue to vigorously prosecute any individual who attempts to victimize any child."

"Today's lengthy prison sentence is fitting for someone who robbed a child of their innocence and continued to sexually exploit them by freely trading the illegal images with predators around the world," said James Spero, special agent in charge of HSI Buffalo. "We will continue to aggressively target those who prey upon and sexually exploit our children. We owe it to the young victims in these cases, who will carry the emotional and physical scars of these crimes with them for the rest of their lives."

This investigation was part of Operation Predator, a nationwide HSI initiative to protect children from sexual predators, including those who travel overseas for sex with minors, Internet child pornographers, criminal alien sex offenders and child sex traffickers. HSI encourages the public to report suspected child predators and any suspicious activity through its toll-free hotline at 1-866-DHS-2-ICE or by completing its online tip form. Both are staffed around the clock by investigators.

The sentencing is the culmination of an investigation by HSI; Dunkirk Police Department; New York State Police Internet Crimes Against Children Task Force; and the Chautauqua County District Attorney's Office. Additional assistance was provided by the Western New York Regional Computer Forensics Laboratory, which conducted the forensic analysis of the defendant's computer.
