Minnesota Pollution Control Agency Update for Hearing Notice for Proposed Rules Adopting Federal Permitting Requirements for Emission of Greenhouse Gas

Dear Interested Parties:

 

The Minnesota Pollution Control Agency (MPCA) received more than the 25 requests needed to hold its scheduled hearing on the rules proposed in its July 9, 2012, Notice to Adopt permanent rules requiring permits for those entities emitting greenhouse gas above a certain threshold (notice archive at this link: www.pca.state.mn.us/index.php/public-notices/archived-public-notices.html). The Agency will not seek withdrawal of any requests prior to the hearing. The hearing will occur at the Minnesota Pollution Control Agency, 520 Lafayette Road, St. Paul, MN 55155, on August 30, 2012, from 2:00 to 4:30 p.m., in Room 4.1. This process is governed by hearing provisions found in Minn. Stat. § ch. 14 (www.revisor.mn.gov/statutes/?id=14) and Minn. Rules, ch. 1400 (www.revisor.mn.gov/rules/?id=1400).

 

The MPCA must comply with the hearing details described in the legal notice. The MPCA tried to schedule a convenient time based on past experience with common participants in rulemaking proceedings. You are not required to attend to express your concerns related to these rules. The presiding Administrative Law Judge will provide instructions to submit written concerns that will be considered part of the hearing record and the Judge’s ruling (these typically must be received within five days following the hearing).

 

The Honorable Manuel Cervantes of the Office of Administrative Hearings will serve as the Administrative Law Judge overseeing the hearing and rulemaking procedures. Generally, the MPCA will introduce the proposed rule and supporting documents at the hearing and will present testimony regarding the need for and reasonableness of the rule.  Interested parties may testify or submit written comments about concerns specific to the proposed rules or to the MPCA’s process.  The judge will then establish a time period for the Agency to respond to comments of record, after which he will issue written findings on the rules and process.
