This position is located in the Department of Labor, Office of Workers' Compensation Programs, Division of Energy Employees Occupational Illness Compensation. The Energy Employees Occupational Illness Compensation Program Act (EEOICPA) provides compensation and medical benefits for covered workers who sustain employment related illnesses as a result of exposure to beryllium, ionizing radiation, and other hazards unique to nuclear weapons production and testing. Survivors of deceased covered workers are entitled to file claims for survivors' benefits. This position serves as a Unit Chief of the Policy, Regulations, & Procedures Branch (BPRP), Division of Energy Employees Occupational Illness Compensation (DEEOIC), Office of Workers Compensation Programs (OWCP). The mission of DEEOIC is developing, establishing and implementing policies, regulations and procedures necessary for the administration of benefit provisions of the Energy Employees Occupational Illness Compensation Program Act (EEOICPA) of 2000 (Public Law 106-398) as mandated by Executive Order 13179 dated December 7, 2000. This Branch is responsible for developing the regulations and procedures necessary for the judicious administration of the EEOICPA and providing technical opinions, interpretations and assistance to DEEOIC staff on specific claims for benefits or medical services. The regulations, policies and procedures must be maintained up-to-date to reflect changes in legislation, court decisions, legal interpretations, scientific opinions, and issues identified by the programs Federal Agency partners or other stakeholders. The Branch also provides recommendations to the Director, DEEOIC, with respect to the reopening of claims for which final adjudications have been issued and ensures the continued development of claims transferred from the OWCP District Offices to the National Offices Final Adjudication Branch (FAB). The incumbent must routinely weigh evidence and exercise sound legal judgment on the disposition of the case. The incumbent must clearly articulate factual and legal reasons for the denial of a claim so that it is upheld by any federal district court reviewing the Final Adjudication Branch (FAB) decision. The incumbent's decisions are normally accepted as drafted by the hearing representative who has signature authority.
