In alignment with Presidential Proclamation of February 4, 2022 under Section 201 of the Trade Act of 1974 providing for a tariff rate quota (TRQ) for Crystalline Silicon Photovoltaic (CSPV) cells and an additional duty for modules comprised of CSPV cells, a new quota period and modified additional duty tables go into effect February 7, 2022.
NEW “A Proclamation to Continue Facilitating Positive Adjustment to Competition From Imports of Certain Crystalline Silicon Photovoltaic Cells (Whether or Not Partially or Fully Assembled Into Other Products)” Signed on February 4, 2022 (www.whitehouse.gov) describes the continuation of CSPV Tariff Rate Quota through February 7, 2026 with adjustment to the annual quota limit and over-quota duty calculations. The Proclamation also provides additional duty calculations for non-quota CSPV goods and adds the following item to the list of goods excluded from additional duties described under HTS 9903.45.25:
Bifacial solar panels that absorb light and generate electricity on each side of the panel and that consist of only bifacial solar cells that absorb light and generate electricity on each side of the cells.
